BigHeds' Challenge: Rules and Regulations
1. Instructions, prizes and information on how to enter form part of these conditions of entry. By entering, entrants accept these conditions of entry.
2. Contest is open only to legal residents of the 50 United States, District of Columbia , and Canada - excluding Quebec . Residents of Puerto Rico , U.S. Virgin Islands , Guam , and other territories of the United States of America , and any other territory prohibited or restricted by law are not eligible. Employees of the Promoter and/or Volare, LLC, of participating outlets and of the agencies associated with this promotion (including the immediate family members of the before mentioned people) are ineligible to enter.
3. The contest will commence on August 1, 2008 and closes December 31, 2008 11:59pm AEDST. One prize to be won thirty (30) days after the closing date. Contest may be extended if deemed necessary by Promoter. No purchase is required, but it may aid in answering the challenge questions.
4. To enter, Participants must be a member to the BigHeds Club. Membership is free and participants can register by visiting www.bigheds.com . Entrants must offer a complete answer to the questions provided. No responsibility is accepted for late, lost, incomplete, illegible or misdirected entries.
5. After registering to the BigHeds Club, Participants may visit www.bigheds.com. Participants must search the site daily for a new trivia question, which will reveal after time is spent on the unspecified site page that contains the daily trivia question. The question and page will change daily. Only one answer to a given question is permitted, right or wrong. Anyone may enter the contest up to the close date and will be allowed to play “catch up”. The Promoter and Volare, LLC reserves the right to verify the validity of entries. The Promoter and Volare, LLC reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these conditions of entry.
6. This is a game of knowledge and chance plays no part in determining the winner. Trivia questions pertain to the website and the BigHeds, including information found in products (excluding the BigHeds' Educational Packet).
7. Judging will take place January 1 through January 31, 2009 unless the contest date is extended by the Promoter. Participants will be judged based on the number of questions answered correctly. The best valid Participant as determined by or on behalf of Volare, LLC will win the prize. The judges' decision is final and no correspondence will be entered into.
8. There will be one winner. Winner will be chosen among the participants with the highest number of correctly answered questions. In the event of a tie, the winner will be randomly selected from the pool of highest ranking participants. The prize amount will be based on the percentage of questions answered correctly by the prize winner. The percentage of correctly answered questions will be multiplied by $5000.00 up to a maximum dollar amount of $5000.00 US Savings Bond. All questions and their correct answers will be posted at the end of the contest period (January 1st 2009 unless the contest date is extended by the Promoter).
9. The prize winner will be notified by email and/or certified US postal mail. If a winner cannot take the Prize as stipulated or if it is unclaimed after thirty (30) days of being notified, the winner’s entry will be deemed invalid and the Promoter reserves the right to award the prize to the second best valid entry.
10. Where any prize is unavailable for any reason, the Promoter reserves the right to substitute that prize for a prize of equal value.
11. The prize winner must at the Promoter and Volare, LLC’s request, participate in any marketing and promotional activity in relation to winning the prize, free of charge, and consent to the Promoter and Volare, LLC using their name and image in such promotional material.
12. The Promoter and Volare, LLC reserves the right to request winners to provide proof of age or parental consent and identity prior to awarding any prize. Identification considered suitable for verification is at the discretion of the Promoter and Volare, LLC.
13. Eligible participants may be of any age. Parental consent is required for all participants under the age of eighteen (18) before their entries will be considered. Any and all eligible Participants under the age of eighteen (18) must have a signed consent from a custodial parent or legal guardian. Failure to provide signed parental consent on all requested forms will result in the entry being disqualified. Parental consent and waiver form available below. 14. If for any reason this promotion is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter and Volare, LLC) which corrupts or affect the administration, security, fairness, or proper conduct of this promotion, the Promoter and Volare, LLC reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion.
15. The Promoter and Volare, LLC will not be liable for any loss or damage or personal injury suffered or sustained in relation to this promotion or the acceptance of any prizes (whether or not arising from any person’s negligence) except for any liability which cannot be excluded by law, in which case it will be excluded to the minimum allowable by law.
16. All entries will be the property of the Volare, LLC. Any personal information collected will be used by Volare, LLC for the purpose of conducting this promotion. However, you will be receiving our club e-newsletter and promotions notifications. Personal information may be disclosed to contractors and agents assisting with this promotion or to communicate with entrants. Entrants may obtain a copy of Volare, LLC’s privacy policy by accessing www.bigheds.com .
17. Each entrant agrees that his/her entry shall be governed by, and construed under and in accordance with the laws of the State of Ohio , applicable to contracts entered into and wholly performed therein. Each entrant agrees and consents to the exclusive jurisdiction of an independent arbitration panel, consisting of attorneys practicing in the State of Ohio , located in the City of Cleveland . This contest is void where prohibited.

II. WINNER SELECTION AND NOTIFICATION
1. Thirty days after the contest closing date , the potential winner will announced on www.bigheds.com , and will be notified by telephone and/or regular certified U.S. Mail. In the event that the potential winner cannot be contacted directly, Volare, LLC, and/or its agents or representatives will make reasonable good faith effort to personally contact the potential winner using the contact information provided at time of submission, including voicemails, emails, and written notification via regular U.S. Mail. Potential winner will have thirty (30) days to respond to the notification. Failure of potential winner to timely respond to notification will result in the runner-up being notified and deemed the potential winner. Response instructions will be clearly and concisely detailed in any and all regular mail, voicemail and/or email notifications.
2. The Grand Prize consists of up to $5000.00 U.S. Savings Bond.
